My sister is a traveling nurse and recently had a bad accident in Co. There was snow and the trailer (5th wheel toy hauler) jacked and flipped on it's side. They recently sold their home (August) so this is they only "home" they have. They had no idea that there was a difference with full-time or rec on insurance and answered all questions honestly. The insurance company is now saying their claim will be denied because they are full-time. Any input would be greatly appreciated!!!!

they took the money for the premium, by all means get a lawyer. My brother payed his ins money every month and had a claimed denied but won plus lawyer fees, but this was on a different property.

The first thing they should do is READ their policy. There may well be a clause in it that disallows coverage when using the RV for anything other than recreational use. If there is, then too bad for your sister. If not and the insurance company is just making up a rule to deny the claim, then perhaps an attorney could help. However, before hiring an attorney, ask the insurance rep to point out the clause in the policy that precludes their paying the claim.

Some insurance co's will pay but then deduct the added premium. GMAC for one said that is what they would do if my yearly milage was understated.

Yes, get a lawyer. They have obviously not been in it long enough to have understated mileage which is the general standard. This may be the only home they have at this time but they are not necessarily full-timing even if it is their decision to do so. Question for those of you with experience. Is the extra expense for full-timing based on the declaration of full-timing or the amount of travel mileage estimated?

This case sounds very weird in that these people have just sold their house in August and two months later had an accident and now no payment based on the full-timing issue. It should take a lot longer to establish full-timing than two months. Get a lawyer and stop giving information to the insurance folks.

Your premium for camping on an occasional basis would be lower than your premium for full time living due to the usage involved. They probably didn't intentionally misrepresent their usage of the RV but they should have notified the insurance company of their change in circumstances.

If they check their policy there is likely an exclusion for full time living.

An attorney may not be able to help. It's possible that the insurance company is still investigating the claim and may decide to pay it if they determine that this was not misrepresentation. Good luck.

Buy an hour of time from a lawyer. Also file a claim with the insurance commissioner in their state. Write to trailer life, they have a section where they help people and put some pressure, via a letter, on the company and print it in their magazine. Hopefully the insurance company won't want the bad press and will step up.

What insurance company is it?

Strangely enough, the claims person she spoke with make a HUGE deal about the amount of the claim and the effect it could have on the company. They have a 2009 Raptor Velocity 361lev.
